Hope that Hooper and Brody will get the fish with this, although I wouldn't bet
on it. The movie didn't run all the way to its half, so it's way to early for
a showdown and the impeachment of the 2 lttle shark puppets.

The Bush Administration CONFESSED to committing multiple felonies under FISA under the guise that the Executive is always immune from prosecution; even when pretending to have the power & capacity to wage war against a tactic/gerund form of verb/state of mind a/k/a "TERRORISM"

This power is also predicated upon the alleged truthfulness of the "official story" of 9/11.

9/11 aside for a moment; here's just one way you can poke and trick the smarmy bastards to the surface:

FISA For Dummies:

For your consideration....

During and after a Pearl Harbor like tragedy on September 11, 2001, the Executive decides we are at war with a tactic and all those who employ said tactic. While Eisenhower and von Clausewitz are rolling in their graves, the Executive goes to Congress seeking Authorization for the Use of Military Force to wage a war against a tactic/gerund form of a verb?/state of mind; i.e. terrorism. Acting on advice of his counsel, Attorney Marquis De Sade, the Executive includes a request for permission to have intercourse with dogs of "suspected terrorists;" because his legal advisors have informed him via memo that raping dogs is neither unlawful nor torture.

During Congressional debate over expanding the Executive's "gerund verb war time powers," the Executive insists on having language inserted within the AUMF to rape dogs under the guise of domestic military operations. However, Congress would not yield.

Not surprisingly, Congress denied the Executive's request; reaffirming that all Americans, even the Executive, are prohibited by law from engaging in the "statutory rape of dogs" since (For purpose of this argument) FISA makes it a federal felony punishable up to five years in prison; unless the Executive branch successfully raises one of the defenses to prosecution under the FISA statute. With the passage of the Patriot Act, Congress even extended the time for the Executive to show ‘‘good cause’’ for said dog raping, from 24 hours to 72 hours (or 15 days during a time of DECLARED WAR).

Nonetheless, with full knowledge that Congress had denied the request, (i.e. scienter (legal speak for 'guilty mind)), Attorney Marquis De Sade advises the Executive to break the law by secretly assuming the power anyway; ignoring Congress as if it were not even a branch of government. Executive thereafter issues an edict to those serving under him to disregard Congress and the Law by engaging in non-consensual sexual intercourse with dogs owned by “all of them you think they are.”

Three years later, Attorney Marquis De Sade is appointed Attorney General. A year after that, the Executive admits he conspired with now Attorney General Marquis De Sade to break the law against raping dogs. In response to public outcry, A.G. De Sade goes on national television and implicitly states he will not prosecute himself or the Executive because Article II, in a time of war against a gerund form of a verb, empowers the Executive not only to break, but make, execute and interpret ALL LAWS--including laws against raping dogs. A.G. De Sade & the Executive continue justifying their use of the Constitution as a urinal puck by claiming Article II grants the President magically inherent powers to break any law the president sees fit

In the example above, A.G. De Sade & the Executive BROKE THE LAW when they conspired to SCREW THE POOCH.

New York State Penal Law, Section 250.05 Eavesdropping.

A person is guilty of eavesdropping when he unlawfully engages in wiretapping, mechanical overhearing of a conversation, or intercepting or accessing of an electronic communication.

Eavesdropping is a class E felony.

"The President's political authority is controlled by the impeachment decision while the President's (and Vice President's, etc.) individual accountability is controlled by STATE and federal law. The accountability of all federal officers as citizens to the criminal laws is the unifying theme of our system. This point was made most eloquently in 1882 in United States v. Lee:

"No man in this country is so high that he is above the law. No officer of the law may set that law at defiance with impunity. All officers of the government, from the highest to the lowest, are creatures of the law and are bound to obey it.

It is the only supreme power in our system of government, and every man who by accepting office participates in its functions is only the more strongly bound to submit to that supremacy. . . ." (From Pillar to Post: The Prosecution of American Presidents, 37 Am. Crim. L. Rev. 1049)

See also "Clinton v. Jones" i.e. (No immunity for "unofficial conduct; EVER!")

Question Presented: "May the New York State Attorney General exercise the power of prosecutorial discretion and refuse to prosecute the confessed felons described above?"

Answer: CATEGORICALLY... NO.

Reason borders on the ontological.

Unless one buys into the sophistic argument that the NYS Attorney General Office, duly established under one of the specifically enumerated powers of the NYS Constitution, has more power than the document to which it owes its very existence, i.e. the NYS Constitution, then the NYS A.G. is duty bound, as a ministerial matter, to enforce all laws (in this case) mandated by
Article I, Section 12 of the NYS Constitution.

To wit:

"The right of the people to be secure in their persons, houses, papers and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

The right of the people to be secure against unreasonable interception of telephone and telegraph communications shall not be violated, and ex parte orders or warrants shall issue only upon oath or affirmation that there is reasonable ground to believe that evidence of crime may be thus obtained, and identifying the particular means of communication, and particularly describing the person or persons whose communications are to be intercepted and the purpose thereof."

And that's just for openers; since ongoing investigations occurring within prosecution have a tendency to uncover further evidence of other crimes and thereby increase the number and severity of charges against the defendant .....
